Terms of Service

Welcome to Palmou AI("Palmou", "we", "us", or "our"). These Terms of Service ("Terms") govern your access to and use of the website at https://palmou.com, the editor, gallery, community feed, billing portal, and any related APIs or features (collectively, the "Service"). By creating an account or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Who we are

Palmou AI is operated by Palmou Studio, based in Spain. You can reach us at palmoustudio@gmail.com.

2. The Service

Palmou AI is a software-as-a-service tool that processes product photographs you upload. It removes backgrounds and generates new scenes. The Service relies on third-party AI models, currently BRIA RMBG 2.0, Google Gemini 2.5 Flash Image.0 Lite, hosted by Replicate. We may change the underlying models at any time without notice if doing so improves quality, speed, or cost — your output may differ between processed images.

3. Eligibility and accounts

You must be at least 16 years old (or the age of digital consent in your country) to create an account. Sign-in is provided exclusively via Google OAuth; we do not offer email/password authentication. You are responsible for keeping your Google account secure. You may not create more than one account per person to abuse the Free tier.

4. Plans, credits, and billing

The Service uses a credit system. One credit covers one completed image (background removal alone, or scene generation). We currently offer:

• Free: 1 credit on signup, no card required.
• Starter: $19, one-time purchase, 100 credits.
• Pro: $49 per month, 500 credits per month.
• Agency: $99 per month, 1,500 credits per month, API access included.

Prices are in US dollars and exclude any applicable taxes (VAT, sales tax) which we may collect on top depending on your billing address. Payments are processed by Stripe; we do not store your card data. Paid plans renew automatically at the end of each billing period unless you cancel before renewal. You can cancel at any time from the billing page. Cancellation stops future charges but does not refund the current period. Unused credits remain available until your plan expires; on Pro they roll over up to twice the monthly allowance.

We reserve the right to update pricing. Existing subscribers will be notified by email at least 14 days before any price change takes effect.

5. Refunds

Because the Service consumes external compute resources on every generated image, completed jobs are non-refundable. If a job clearly fails for technical reasons (model timeout, content-moderation false positive, or any error on our end), we automatically refund the credit to your account. For other circumstances — duplicate purchase, accident — contact us at palmoustudio@gmail.com within 14 days of the charge and we will review case by case in accordance with EU consumer law (right of withdrawal under Directive 2011/83/EU, where applicable).

6. Acceptable use

You agree not to use the Service to:

• Upload or process images you do not have the right to use, including third-party copyrighted material, trademarked logos, or images of identifiable people without their consent.
• Generate sexually explicit content, content depicting minors in any sexualized way, content promoting violence or hatred, or content that violates Replicate's or BRIA's usage policies.
• Misrepresent generated images as authentic photographs in regulated contexts (medical, legal, judicial evidence) where doing so would be unlawful or misleading.
• Reverse-engineer, scrape, or attempt to bypass rate limits, credit deductions, or content moderation.
• Resell the Service or repackage outputs as a competing AI image tool.

BRIA RMBG 2.0 includes automated content moderation. Images flagged as non-compliant are rejected and credits are refunded. Repeated attempts to bypass moderation may result in account suspension without refund.

7. Ownership of generated images

You retain all rights to images you upload. As between you and us, you own the generated outputs and may use them for any lawful purpose, including commercial use (e-commerce, advertising, social media, printed catalogs, etc.). The underlying models used to generate the outputs are licensed for commercial use through Replicate.

We do not use your uploads or outputs to train any AI model. Your images are stored encrypted at rest in our European Supabase storage and are accessible only to your account.

You grant Palmou a limited, non-exclusive license to host, process, and display your images solely for the purpose of providing the Service to you. If you choose to publish an image to the public Community feed, you additionally grant us a non-exclusive license to display that image on the public Community page until you delete it.

8. Service availability

We strive for high availability but the Service is provided on an "as-is" and "as-available" basis. We do not guarantee uninterrupted operation, particularly given our reliance on third-party AI providers (Replicate, Supabase, Stripe, Vercel). The Agency plan includes a 99.9% monthly uptime target as a service-level objective; if we miss it for two consecutive months we will issue a prorated credit on request.

9. Limitation of liability

To the maximum extent permitted by law, Palmou's total aggregate liability for any claim arising out of or relating to these Terms or the Service is limited to the greater of (a) the total amount you paid us in the twelve (12) months preceding the claim, or (b) one hundred US dollars (USD 100). We are not liable for indirect, incidental, consequential, or punitive damages, including lost profits, lost data, or business interruption.

Nothing in these Terms limits liability that cannot be limited by law — including, in the EU, liability for fraud, gross negligence, or death/personal injury caused by negligence.

10. Indemnification

You agree to indemnify and hold Palmou harmless from any third-party claim arising from your misuse of the Service, your violation of these Terms, or your infringement of any third party's rights — in particular intellectual-property or privacy rights related to images you upload.

11. Termination

You can terminate your account at any time by deleting it from your billing page or by emailing us. We may suspend or terminate your account immediately, without refund, if we determine that you have materially violated these Terms — for example by uploading prohibited content, attempting to defraud us, or abusing the Free tier with multiple accounts.

Upon termination, your access to the Service ends, your stored images and processed outputs are scheduled for deletion within 30 days, and your remaining credits are forfeited. Sections that by their nature survive termination (Ownership, Liability, Indemnification, Governing Law) continue to apply.

12. Privacy

Our processing of your personal data is described in our Privacy Policy, which forms part of these Terms.

13. Changes to these Terms

We may update these Terms from time to time. Material changes will be announced by email and on this page at least 14 days before they take effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms. The "Last updated" date at the top of this page reflects the current version.

14. Governing law and disputes

These Terms are governed by the laws of the Kingdom of Spain. Any dispute arising from or related to these Terms or the Service that cannot be resolved amicably will be submitted to the exclusive jurisdiction of the courts of Spain, without prejudice to any non-waivable consumer-protection rights you may have in your country of residence.

EU consumers may also use the European Commission's online dispute resolution platform at ec.europa.eu/consumers/odr.
